Lectra Software
The Lectra Software and accompanying documentation
that is made available to you is the copyrighted and/or patented work of
LECTRA. Use of this
Software is governed by the terms of the License Agreement signed by your
company or which is included with such Software. You may
either have a Permanent license, a Security license, or a Try or Buy license.
In any case, by installing or downloading the Software, you agree and are bound
by the terms of the Licence Agreement. An extract of the terms is provided
herein for your review.
Permanent license for Lectra Software
In the event this software is subject to a Permanent
License, you are granted a non-transferable, non-assignable, non-sublicenseable
and non-exclusive right to use it in executable code form only, for your own
internal business purposes, for the duration set out in the License Agreement
or if no duration is specified for the applicable legal copyright duration. The
grant of a Permanent License is subject to the full payment of the license
fees.
Your use of the Software shall be in accordance with
the type of license defined in the License agreement signed by your company. It
shall be one of the below type:
(a) “Fixed license”, the Software is licensed for use,
installed and operated on a single computer which shall be identified with a
dongle. It is understood and agreed that such license does not allow the
Software to run on a server multi-user system (such as Windows Terminal Server
or Citrix Metaframe).
(b) “Named-user license”, the Software is licensed for
use on any computer connected to the licensed server by all specified users simultaneously
provided (i) the user's name (Windows login name) is on the list of allowed
users on the licensed server and (ii) the number of names in the specified user
list does not exceed the number of licenses and (iii) only such specified named
users use the Lectra Software. In such case, the license is granted in
conjunction, and may only be used, with a server license.
(c) “Floating license”, the Software is licensed for use
by your personnel on any computer connected to the licensed server, for a
limited number of users equal to the actual number of licenses of the same
software program lawfully detained by your company. In such case, the license
is granted in conjunction, and may only be used, with a server license and the
maximum number of users who may use the Software over the network
simultaneously at any given time cannot exceed the number of licenses lawfully
detained by your company under the License agreement signed with Lectra.
Security license for Lectra Software
In the event this software is subject to a Security
License, you are granted the same rights as under article 1, but these rights
shall expire on the date on which payment is due. You are informed and accept
that this licence will expire in case of failure of payment in due time. If the
payment is duly made on or before the due date for payment, you will
automatically be granted a Permanent License as defined above.
Try and Buy License for Lectra Software
In the event this Software is subject to a Try and Buy
License, you are granted the same rights as under article 1, but these rights
shall expire within three months as from the date of delivery of the Software.
You are granted a non exclusive and non transferable right to use this Lectra Software
for the unique purpose of evaluating and comparing its capacities with your
needs.
